Software License Agreement: Axis The Information Technology Professionals, LLC (AxisITP)

IMPORTANT NOTICE:

These rights are protected under United States copyright laws, other applicable laws, and international treaties. AxisITP retains all rights not explicitly granted in this agreement.

2. Restrictions on Use:
   You are prohibited from redistributing, selling, decompiling, reverse engineering, or disassembling the software. While you may modify the source code within the HTML, ASP, PHP, and ASPX files for customization purposes, you may not resell, redistribute, or offer the software (or any modified versions) as a service without explicit written permission from AxisITP. AxisITP reserves the right to deny the use of its software to any individual or entity at its sole discretion.

Licensing Terms

1. Individual Licenses:
   Each copy of the software requires a separate license and must be registered with AxisITP. Licenses are valid only for the registered domain/URL. You are not permitted to duplicate the software without purchasing additional licenses. This license does not grant reseller privileges.

2. Server Licenses:
   If a server license is purchased, the software is licensed exclusively for use on the registered server. Each server license applies to one (1) physical server. The software must remain on the licensed server at all times. Server licenses do not grant reseller privileges.

Disclaimer of Warranties

The software is provided "as is" without any warranties, express or implied, to the extent permitted by local law. AxisITP explicitly disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Your use of the software is entirely at your own risk.

Limitation of Liability

To the fullest extent permitted by law, AxisITP, its employees, and officers shall not be liable for any direct, indirect, incidental, consequential, or special damages (including but not limited to lost profits, lost data, or downtime costs) arising from the use or inability to use the software. This applies regardless of the legal theory (warranty, contract, tort, or otherwise) and even if AxisITP has been advised of the possibility of such damages.

Return Policy

1. Non-Refundable Software:
   Software purchases, including all associated files (HTML, ASP, PHP, ASPX, graphics, images, and text), are non-refundable. This policy applies to all software that includes source code or is not explicitly labeled as "trial software."

2. Support Services:
   If you encounter issues with the software, AxisITP provides technical support to resolve problems. Refunds are not available for installation services or software that has been downloaded, installed, or emailed to you.

3. License Key Validity:
   To prevent credit card fraud, the initial license key provided is valid for 90 days. After this period, a new lifetime license key will be issued free of charge for the registered domain.

Support Services

1. Free Support:
   Some software and services include limited free support (technical assistance, re-downloads, and updates) for one year from the date of purchase. Free support is available exclusively through our website or email.

2. Advanced Support:
   For advanced technical support or telephone assistance, additional consulting services or a support plan may be required. AxisITP reserves the right to modify its support policies at any time.

Installation

1. Data Responsibility:
   You are responsible for safeguarding your data and files during installation, upgrades, or updates. AxisITP is not liable for any data loss or other damages resulting from these processes. Regular backups of your hard disk and data are strongly recommended.

2. Optional Installation Service:
   If you purchase the optional installation service, AxisITP will install the software on your web server and perform basic configuration. This service does not include setup for items, categories, payment gateways, or other elements. AxisITP is not responsible for hosting fees, setup fees, or data loss during installation.

AxisITP is not liable for any loss, damage, theft, misuse, or malfunction of your hardware, data, or other property, regardless of the cause.
